Changes to the Immigration Rules come into effect on 13 December 2012


A number of changes to the Immigration Rules come into effect today (13 December 2012). These changes will affect non-European Economic Area nationals applying to enter or remain in the UK.
The changes include:
  • Non substantive changes to all PBS tiers.
  • Establishing a more robust and clear criminality framework against which immigration applications will be assessed.
  • Amendments to clarify the absences from the UK that are allowed during the continuous residence period for settlement for Tier 1 (General), Tier 2 and pre-points based system work routes (for example work permits, self-employment and business person).
  • Minor changes to the child and parent routes to make them as clear and comprehensive as possible and changes to simplify the operation of the income threshold for sponsoring family migrants.

Processing fees are regulated on 1 January 2013


If you plan to apply for a residence permit or an extension of a residence permit based on work or studies around 1 January 2013, please note that processing fees are regulated on 1 January 2013. 

If you wish to apply before the fees are regulated, you must create a Case Order ID and submit your application before 1 January 2013. It is not possible to create a Case Order ID with the 2013 fee prior to 1 January 2013. This means that if you wish to submit your application after 1 January 2013, it is important that you create your Case Order ID on 1 January 2013 or later.

In other words, it is the date on which you submit your application to the Danish Agency for Labour Retention and International Recruitment, to the Danish police, or at a Danish diplomatic mission, which decides the amount of the fee. If you have paid less than the required amount, your application will be rejected, that is, it will not be processed.

The processing fees for applying for a residence permit are regulated every year on 1 January.

Changes to the Immigration Rules


Today, Thursday 22 November 2012, a written ministerial statement has been laid in Parliament outlining a number of changes to the Immigration Rules which will come in to force on13 December 2012.
These include non substantive changes for sponsors and migrants coming to the UK under the following routes of the points-based system:
  • Tier 1 - entrepreneurs and investors.
  • Tier 2 - skilled workers, including changes for senior intra-company transfers.
  • Tier 4 - students, including extending the interim limit.
  • Tier 5 - temporary workers including the requirements for the government authorised exchange category and private servants in a diplomatic household.
  • Sponsorship - revised sponsorship guidance will be published in December.

Changes to the Immigration Rules


A written ministerial statement has been laid in Parliament today outlining a number of changes to the Immigration Rules.
The changes amend the Immigration Rules further to theSupreme Court's judgment in the case of Alvi . They follow on from the earlier changes on 19 July 2012 in response to the same judgment, which required that requirements that were previously set out in Home Office guidance be incorporated into the Immigration Rules.
Some further amendments that are not related to the Supreme Court's judgment are also being made, including:
  • changes to the family and private life rules and the transitional provisions for dependants of points-based system migrants;
  • changes to Tier 1 (Exceptional talent) of the points-based system; and
  • changes to the list of low risk countries for the purpose of Tier 4 of the points-based system.
The rules changes will come into effect tomorrow (6 September 2012), except the changes to the list of low-risk countries for Tier 4 and the Tier 1 (Exceptional talent) route, which will come into force on 1 October.

Australia ease visa processing for student from 29 countries


A statement released today by the Minister for Immigration and Citizenship, Chris Bowen MP, announced that the Government will make the visa application process easier for students from29 countries by reducing assessment levels across a range of student visa subclasses. These changes go into effect from 24 March 2012.
The news comes in response to the Department of Immigration and Citizenship’s (DIAC) 2011 review of student visa assessment level settings, which, as reported in a previous post, recommended that a number of assessment levels be changed.
“While it was recommended that some assessment levels be increased, I have decided to only implement the reductions in order to best support Australia’s international education sector,” Mr Bowen said.
“Lowering the minimum evidentiary requirement for the grant of a student visa for selected countries and visa subclasses is expected to help around 10,500 prospective students.
These changes will particularly benefit the postgraduate research sector, English Language Intensive Courses for Overseas Students (ELICOS) and vocational education and training (VET) providers.”
For example, South Koreans studying VET and ELICOS courses and postgraduate research students from China, India and Indonesia will now find it easier to apply for visas.
“The reduction in assessment levels builds on the measures implemented as a result of the Strategic Review of the Student Visa Program, undertaken by the Hon. Michael Knight, to ensure Australia remains an attractive study option for overseas students,” Mr Bowen said.
Assessment levels are an important tool in managing the student visa programme, as they ensure the efficient delivery of services to a diverse range of students while supporting the integrity of Australia’s immigration programme.
Universities Australia welcomed the changes to the student visa system, “It really is a terrific outcome not just for the higher education sector but for the Australian economy more broadly because at a time we’re seeing manufacturing struggling, tourism struggling, both primarily because of the strong Australian dollar, it’s really important for those industries that are strong to be able to step up to offset some of those economic implications,” said Universities Australia chief executive, Belinda Robinson.
“The international education sector is Australia’s third largest export industry, and over the 2010-11 period international higher education students spent an average of AU$38,000 each in this country on goods, services and fees. While it may be a little more expensive to live and study in Australia [right now], the quality of living, employment opportunities, student mix and the quality of universities makes Australia a very appealing place for those seeking to study abroad,” Ms Robinson added.

STUDY GRANTS FOR THE ACADEMIC YEAR 2010/2011 OFFERED BY THE 
GOVERNMENT OF ITALY TO FOREIGN CITIZENS. 

The Ministry of Foreign Affairs offers study grants for 72 monthlies amounting Euro 700 to students 
and graduate citizens of Pakistan for the academic year 2012/2013. 

Required requisites: 
• knowledge of Italian language;

Minister Shatter announces extension of Irish Short-stay Visa Waiver Programme


The Minister for Justice, Equality and Defence, Mr. Alan Shatter, T.D., today announced Government agreement for the extension of the Irish Short-stay Visa Waiver Programme for a further period of four years. This initiative, introduced for the first time last year, was welcomed as a very positive step in encouraging visitors to Ireland. The programme had originally been due to last until the end of October this year but on consideration of a review of the Programme, the Government agreed to extend its duration.
The Minister also announced the following changes to the Programme;
 Bosnia and Herzegovina will be added to the existing list of 16 countries already covered by the Programme;
 As a further measure to encourage tourism, the fee for visas will be waived for long-term residents from the countries covered by the Programme who live in the Schengen area. This will be reviewed after six months. Read the Minister's Press Release.

Shatter announces two new initiatives: Immigrant Investor Programme and Start-up Entrepreneur Scheme

The Minister for Justice, Equality & Defence, Mr. Alan Shatter, TD, today announced Government approval for the introduction of two major new immigration initiatives aimed at facilitating (non EEA) migrant entrepreneurs and investors who, in return for permission to reside in the State, are prepared to invest here for the purpose of saving or creating jobs. Ireland-UK agreement to further secure the Common Travel Area

Minister Shatter has signed an agreement with the UK Minister for Immigration reinforcing Ireland and the UK's commitment to preserving the Common Travel Area and to take joint action to tackle immigration abuses. This will include the exchange of information such as fingerprints and biographical details on visa applicants, particularly from high risk countries. Business Skills Program Reforms – 1 July 2012


On 25 May 2012, the Minister for Immigration and Citizenship, the Hon Chris Bowen MP announced changes to the Business Skills visa program - now named the Business Innovation and Investment program. These changes will be implemented from 1 July 2012.
The changes are the result of a comprehensive review which was conducted during 2011.

Summer 2011 interns exempt from Tier 2 cooling off period


Students who worked as interns in the UK last summer and want to return to a graduate job with the same company are now temporarily exempt from cooling off rules.
Cooling off rules, introduced to Tier 2 (General) in February this year, mean those who have left Tier 2 need to wait a year from the end of their last application before they can apply again through that route. This is similar to the arrangements we put in place for intra-company transfers last year.
To qualify for the temporary exemption, which is available until 31 October, you must:
  • be sponsored by the same company where you worked as an intern in the summer of 2011;
  • have previously been granted permission under Tier 2 (General) with that company for a temporary job lasting no more than 4 months as an intern or a summer associate;
  • have completed a degree course within 18 months of your application;be returning to the UK on a graduate trainee scheme; and
  • be making a Tier 2 (General) application with a start date on the certificate of sponsorship of 31 October 2012 or before.
Tier 5 is the most appropriate route for internships and a number of Tier 5 (Government authorised exchange) schemes are available. Employers should use these in future if they are concerned about the impact of the cooling off period on their interns.
The Tier 2 policy guidance and sponsor guidance will be updated by 14 June. As this exemption is temporary, it will not be included in the Immigration Rules.

New screening to tackle tuberculosis in the UK (21 May, 2012)


A pre-entry tuberculosis (TB) screening programme will help save lives and save taxpayers more than £40 million over 10 years and, announced Immigration Minister Damian Green today.
The new measures mean migrants wanting to enter the UK for more than 6 months, from 67 countries with a high incidence of TB, will need to be screened before they are granted a visa for the UK.
Immigration Minister Damian Green said:
'A third of the world's population is carrying tuberculosis and it is currently at its highest level in the UK for 30 years. It's essential that we take action to tackle its continued rise. Pre-entry screening, followed by treatment where necessary, will help to prevent the risk of TB in the UK and will also save lives.
'Removing screening facilities at airports will save the taxpayer £25 million over ten years and further NHS savings will be made by preventing the importation and spread of TB in the UK.'
The introduction of pre-screening comes as recent figures showed that there were over 9,000 new cases of TB in the UK in 2011, a 5 per cent increase on 2010. The programme is targeted at migrants after research showed non-UK born people accounted for three quarters of all new TB cases diagnosed - 20 times higher than in the UK born population.
The UK Border Agency will build on existing pre-screening undertaken by international partners including the USA, Canada and Australia. The costs of screening and subsequent treatment will be met by those people applying to come into the UK.
